Evergreen law guide

Hawaii licenses medical cannabis cultivation and dispensaries on an island-by-island basis, and possession of small personal amounts is treated as a civil violation rather than a crime. Inter-island shipment of cannabis is prohibited, which splits the market geographically. Hemp is grown under a state agricultural plan with THC testing.

Island geography is the defining compliance constraint: a product lawful on one island cannot simply be moved to another under the same licence.

Business impact

Operators must plan production capacity per island rather than centrally, because product may not cross water between licensed premises. Hemp growers face the same logistics for testing and processing.
