Evergreen law guide

Idaho authorises hemp cultivation and processing under a state plan approved by the federal agriculture department, with pre-harvest testing and a disposal obligation for lots over the THC limit. There is no medical or adult-use cannabis programme. Possession of THC-bearing cannabis is a criminal matter, and the state has taken the position that its own hemp framework does not authorise consumable products containing THC.

Transport through the state is a specific risk point: loads inspected at the border can face enforcement even where the material is lawful at its point of origin.

Business impact

Transporters routing hemp through Idaho should carry complete documentation and expect inspection. Retailers should avoid stocking consumable THC products of any concentration, because state law does not recognise a lawful retail category for them.
