Texas restricts consumable hemp products as port enforcement tightens

Consumable hemp products containing THC have been brought under tighter state restriction, and importers at Texas ports are facing examination.

Texas has narrowed what may lawfully be sold as a consumable hemp product, limiting products containing THC and placing the compliance burden on the retailer rather than the producer. There is no general medical or adult-use cannabis programme in the state, so a retailer holding a restricted product has no licensing route to fall back on.

In parallel, importers moving hemp-derived intoxicating products through Texas ports have faced heightened examination, with holds resolved on production of testing records and formulation documents.

Retailers should treat each product line as a separate question. A product permitted in a neighbouring state can fall outside the Texas categories entirely, and the state has treated product claims and labelling as the trigger for enforcement.
