Evergreen law guide

Texas licenses hemp cultivation and processing under a state plan, and has moved to restrict consumable hemp products containing THC, limiting which products may be sold at retail. There is no general medical or adult-use cannabis programme, though a narrow low-THC programme exists for certain patients. Federal enforcement attention on imported hemp-derived intoxicating products has been concentrated at the state's ports and major metropolitan markets.

Retail enforcement has targeted products that fall outside the permitted categories, and the state has treated labelling claims as the trigger for action.

Business impact

Retailers and importers face the sharpest risk here: a product permitted in another state may be restricted in Texas, and imported shipments are being examined. Keep import documentation and product testing records for every lot.
