California moves intoxicating hemp inside the licensed cannabis system
A seller of intoxicating hemp-derived products must now sit inside the cannabis licensing track rather than the agricultural one.
California has closed the gap between its hemp programme and its cannabis licensing system by bringing intoxicating hemp-derived products inside the cannabis track. The change means a retailer selling those products without a cannabis licence faces civil penalties rather than operating in an ambiguous category.
Local jurisdiction still matters. A state licence does not override a city or county that restricts cannabis retail, and many municipalities do.
At the same time, shipments of imported hemp-derived intoxicating products arriving through the state's largest ports have been examined more closely, which has lengthened lead times for importers who relied on overseas intermediates.
